American Airlines, Inc., under 49 USC 40109, hereby applies for an exemption authorizing foreign air transportation of persons, property, and mail between points in the United States and points in Turkey, with the right to integrate such authority with American's certificates of public convenience and necessity and other exemptions. Such authority will be used to implement a proposed codesharing arrangement between American and Turkish Airlines, described in the accompanying joint application of American and Turkish Airlines for statements of authorization under 14 CFR Part 212.

Cielos is a flag carrier of the Republic of Peru and currently holds exemption authority from the Department to engage in scheduled foreign air transportation of property and mad between Lime and Iquitos, Peru, on the one hand, and the co-terminal points Miami, New York, Houston and Los Angeles, on the other, via intermediate points in Colombia, Panama and Costa Rica. Cielos also holds Peru-U. S. cargo charter exemption authority. Notice of Action Taken, dated August 31, 1999, in Docket No. OST-95-617. In performing Peru-U.S. service, Cielos is required to wet lease from another duly authorized and property supervised U.S. or foreign air carrier. In the Notice of Action Taken authorizing Cielos to operate Peru-U. S. scheduled all-cargo service, the Department found that Cielos was operationally and financially qualified to undertake the proposed service. There have been no significant changes in the information upon which those findings were based or in the ownership of Cielos.
By this application, Cielos requests exemption authority to permit it to operate scheduled all-cargo services "between the United States and any point or points" in accordance with the route description in Annex I to the 1998 U.S. -Peru Air Transport Agreement. Cielos also requests 7th Freedom cargo charter rights in accordance with Annex II of the Agreement.

Tradewinds reluctantly opposes LOT's application unless and until Tradewinds' pending application before the Poland Civil Aviation Department for permission to operate bilaterally-authorized charter services between the United States and Poland is granted. On February 1, 2000, Tradewinds filed a request with the Poland Civil Aviation Department for permission to operate a charter program between the United States and Poland beginning June 2000 through September 2000. Tradewinds' planned operations are extremely modest, involving only 3 weekly flights between Chicago/New York and Warsaw, two markets served by LOT. Tradewinds holds a certificate of public convenience and necessity issued by the Department authorizing Tradewinds to conduct worldwide charter authority and has been formally designated by the United States government to provide U.S.-Poland services under the U.S.-Poland bilateral agreement. Since Tradewinds' operations are fully authorized under the U.S.-Poland bilateral, there is no legitimate basis for the government of Poland to delay authorization of Tradewinds' request.
LOT's application for exemption authority is based upon the 1996 provisional agreement between the United States and Poland authorizing additional code-share points. It would be untenable for the U.S. government to take favorable action on LOT's application under the provisional agreement while Tradewinds' bilaterally-authorized proposal to operate charters between the United States and Poland languishes on the Polish Civil Aviation Department's docket.

Vanguard proposes to operate two (2) daily round-trip flights between Kansas City and DCA using existing Stage-3 compliant Boeing 737-200 aircraft from its fleet. In order to benefit the greatest number of travelers and ensure the success and viability of its new service, Vanguard requires a minimum of four slots at the following times:

These slot times will enable Vanguard to implement not only nonstop MCI-DCA service, but also connecting and/or single-plane service between DCA and Chicago (Midway), Dallas/Ft. Worth, Denver and Minneapolis/St. Paul. One of the two MCI-DCA daily flights will include one-stop/single-plane service to Denver, and one will include one-stop/single-plane service to Minneapolis/St. Paul. Complete schedules of Vanguard’s proposed nonstop, connecting and one-stop/single-plane services are set forth in Exhibits A and B. Kansas City-Washington, D.C. is a high-volume O&D market that would clearly support Vanguard’s twice-daily service proposal. Vanguard forecasts that its low-fare MCI-DCA service will benefit over 115,000 one-way passengers.
