United welcomes the implementation of a new open aviation regime between the U.S. and Portugal made possible by the conclusion, ad referendum, of an open skies agreement between the two countries on December 22, 1999.1 United is anxious to obtain authority to introduce new U.S.-Portugal service in conjunction with its code-share partners, Lufthansa, Spanair and British Midland, consistent with the terms of the agreement. United is currently awaiting approval of its application filed on February 16, 2000, with the government of Portugal to commence third-country code-share
operations with Spanair between Madrid and Lisbon and with Lufthansa between Frankfurt and Lisbon, Porto, and Faro.
United is in the process of providing additional documentation requested by the Portuguese aviation authorities to process its application. If, as United hopes, its application is then approved without delay, and United has received no indication that it will not be, United has no objection to TAP's application for broad U.S.-Portugal open skies exemption authority. Prior to granting TAP's application, however, the Department should ensure that United's pending application is approved in full.
United agrees with TAP that the public interest will be served by the "enhanced and competitive international air transportation opportunities" generated by the open skies agreement. TAP Application at 5. These competitive benefits will only be realized, however, if U.S. carriers are granted authority to implement U.S.-Portugal service contemporaneous with the introduction of new service by TAP, to ensure that they are afforded a level competitive playing field.

TWA, pursuant to 49 U.S.C. § 40109 and Subpart D of the Department's procedural regulations, hereby applies for an exemption from 49 U.S.C. § 40101 to permit TWA to engage in the foreign air transportation of mail between the United States and Japan, pursuant to TWA's code-share arrangement with ANA. Initially the code-share operations will be between Chicago, Guam, Honolulu, Los Angeles, San Francisco and New York, on the one hand, and the following points in Japan, on the other hand: Osaka (Kansai), Nagoya and Narita.
