The proposed Continental Express flights would serve the public interest by providing the only existing single-plane service between Hartford and LaGuardia, thereby enhancing the flow of traffic between Hartford/Springfield and New York and offering passengers new service options. Pittsburgh's proposed retaliatory sanction not only harms Chicago and U.S. consumers, but also is clearly inconsistent with Department slot exemption precedent. The Department has never in the history of slot exemptions denied a timely slot exemption request made by a foreign carrier that meets the Department's procedural requirements. Indeed, the Department' wisely has resisted using the slot exemption as an instrument of foreign policy. In fact, the Department has routinely approved foreign carrier slot exemption requests that meet. the Department's minimum criteria and rejected calls by many U.S. carriers to deny a foreign carrier's exemption requests because of alleged reciprocal access issues at foreign airports.5 And, in denying these request, the Department has recognized that retaliatory actions in air service disputes that entail the cessation of existing service are rarely, if ever, in the best interests of the United States.
