The effect of these "reservations" would be to thwart Sun Country's application by imposing upon the pending request for two slots the same procedural and analytical requirements used to determine JetBlue's application for 75 slots at JFK. The cases presented by Sun Country and JetBlue are clearly distinguishable. JetBlue has not demonstrated any credible grounds for its contentions. The Department should not be coaxed into delaying action upon Sun Country's application by accepting the false parallel asserted by JetBlue.

American sought the subject frequencies in order to engage in codesharing services between the U.S., on the one hand, and Moscow and St. Petersburg, on the other, under an arrangement with Finnair. Regrettably, the Russian aeronautical authorities have not yet granted necessary authorizations for American and Finnair to begin such services. Although American's efforts to secure Russian approval are continuing, it does not appear that approval will be in hand in time to commence services by the end of the dormancy period on April 22, 2000.

Hereby request that the Department issue a Statement of Authorization pursuant to 14 C.F.R. Part 212, permitting TACA to carry the code of Air France on TACA flights between Miami, Florida and Guatemala City, Guatemala for the purpose of transporting Air France traffic between Guatemala and France. The authorization is requested for two years. TACA and Air France desire to implement the code share/blocked space service on or about April 2, 2000. Under the arrangement, TACA will carry Air France's code on its nonstop services between Miami and Guatemala City, which will connect to Air France's service between Miami and France. Only traffic between Guatemala and France will be transported under the Air France code on the TACA code share flights. Air France will not sell travel between Guatemala and the U.S. for movement on the code share flights. TACA's code will not be placed on any of Air France's U.S. -France flights.

In an attempt to establish that comity and reciprocity exists in the U.S.-Colombia market, TAMPA points to the Colombian Government's approval of two U.S. carriers which have been authorized to serve Colombia via the intermediate point Panama, the same routing sought by TAMPA herein. However, the fact that 2 U.S. carriers have been authorized by the Government of Colombia to operate in one particular market, Panama, does not alter the fact that overall substantial comity and reciprocity cannot be said to exist, and has not existed for some time. Further, attempting to isolate a single intermediate point, Panama, and declaring then U.S.-Colombia comity and reciprocity exists on that sole basis, completely the ignores the overall lack of comity and reciprocity and the long-standing, continuing problems faced by U.S. carriers seeking to exercise their bilaterally-authorized rights. The Government should not be permitted to pick and choose which intermediate points U.S. carriers are apparently permitted to serve or how commercially choose to serve them. In consideration of TAMPA's application, the Department should therefore at a very minimum, await the outcome of the upcoming (March 13-14, 2000) resumed negotiations with Colombia where hopefully, these triangular routing, reciprocity and other issues will, once again, be discussed and hopefully this time favorably resolved. Until these issues are satisfactorily resolved, the Department should defer action on the application herein.

Polar supports expansion of U.S.-Colombia service and the further liberalization of the U.S.-Colombia bilateral aviation agreement. It is important, however, that Polar's application for Miami-Bogota all-cargo exemption authority pending in Docket OST-98-3939 be granted no later than TAMPA's application, and that the government of Colombia provide an assurance of routing flexibility so that carriers may develop their Miami-Bogota services with competitive parity.

The recent and repeated public rebukes by the Government of the United Kingdom, at all levels of Government, lays bare its bilateral aviation objective -- to stonewall the U.S.-U.K. bilateral negotiations and to count on U.S. governmental failure to impose costs on British carriers similar to those now faced by U.S. carriers attempting to compete in the U.S.-U.K. market. The choice facing the Department of Transportation in this proceeding is simple: to deny Virgin's request or to prolong the stalemate
