Notice of Action Taken Portland-Osaka Dormancy

By Order 98-5-17, the Department granted certificate authority to Delta to provide service between Portland, Oregon, and Osaka, Japan, and allocated it 7 weekly frequencies to operate this service. The frequencies are subject to the condition that they will expire automatically and revert to the Department for reallocation if they are not used for a period of 90 days. The Department has previously granted Delta waivers of the dormancy condition for its Portland-Osaka services.  Under the terms of the latest waiver, the frequency allocation would expire June 26, 2000. Delta seeks a further waiver of the 90-day dormancy condition for an indefinite period or, alternatively, for a period of at least six months. It states that economic conditions in Asia make it necessary to continue to delay the inauguration of its Portland-Osaka service.

Nordstress itself is not seeking rights to hold out or sell cargo services to shippers. It seeks only the minimal, underlying authority to wet-lease its aircraft to a foreign air carrier, DHL International EC, that does not serve the United States, but has agreed to carry the code of a U.S. air carrier, DHL Airways, on flights operating Brussels-Bahrain-Dubai. This service is operated today with a B-757 freighter aircraft provided by Nordstress. The wet-lease and code-share arrangements on the Brussels-Bahrain segment have previously been authorized by the Department and the parties now seek simply to extend the code-share service from Bahrain to Dubai.  Nordstress respectfully requests that the Department issue amended exemption authority and statement of authorization necessary to permit Nordstress to conduct wet-lease operations for DHL International EC between Bahrain and Dubai as an extension of the Brussels-Bahrain operation that is currently authorized. Nordstress requests that new authority, including full operation Brussels-Bahrain- Dubai, be granted for a period of one year, subject to renewal and standard conditions.

February 15, 2000 Answer of The City of Houston and The Greater Houston Partnership to Motion of Continental Airlines to Consolidate 1999 U.S.-Brazil Combination Service Case / Continental Airlines - Houston-Brazil Dormancy and a Peru-Brazil Frequency Allocation

In its motion, Continental urged the Department to "require American and United to state the minimum number of frequencies they would accept for their proposed services prior to the submission of direct exhibits in this proceeding." Motion Of Continental Airlines, Inc. To Consolidate, February 11, 2000, at 2 n.4. The Houston Parties strongly support, and wish to underscore the importance of, Continental's request that American and United provide this basic and essential information. Once American and United have clarified their intentions, all parties to this proceeding will be better able to focus their individual presentations in response. This in turn will facilitate and expedite the Department's task in adjudicating this proceeding by focusing the issues and alternatives before the Department. The Houston Parties do not believe that the Department need extend the March 2, 2000 deadline for filing direct exhibits in this case, as long as the Department directs American and United to clarify their respective intentions immediately.

Federal Express respectfully moves the Department to grant it leave to file the attached answer responding to UPS's Objections filed on February 11, 2000. In its Objections, UPS asserts that American's petition for reconsideration of Order 2000-1-21, and Federal Express' answer to that petition, are procedurally defective, which is not true. Further, UPS's position that cargo carriers should not have to disclose the extent of their participation in the U.S.-China market is inconsistent with its prior position that the Department should require combination carriers to disclose the same information. Fairness and the public interest therefore dictate that the Department should receive and consider Federal Express' answer to UPS's objections. In addition, since this answer is being filed within one business day of the Objections to which it relates, granting this motion will not unfairly prejudice any applicant or unduly delay this proceeding.

Exemption pursuant to 49 U.S.C. section 40109(g) to permit it to operate one one-way cargo charter flight between Denver, CO, and Cape Canaveral, FL, on or about February 16, 2000, using its AN- 124 aircraft, to transport an oversized launch vehicle, an oversized motor vehicle and a tracking kit on behalf of Lockheed Martin Astronautics. The applicant stated that Lockheed Martin required urgent delivery to meet the scheduled date for mating the vehicle with a satellite, in order to meet launch constraints, that the cargo is too large for transportation on U.S. carrier aircraft, and that surface transportation is not feasible because of the time involved, the adverse effect a long road trip could have on the vehicles, and the vehicles size.
