The Department of Transportation is directing all interested persons to show cause why it should not issue orders (1) finding Ameristar Air Cargo, Inc., fit, willing, and able, and (2) awarding it certificates of public convenience and necessity to engage in interstate and foreign charter air transportation of property and mail. Persons wishing to file objections should do so no later than February 11, 2000.

Order 2000-2-6 is prohibiting Executive Airlines, Inc., d/b/a American Eagle, from suspending service at Ponce, Rico, until suitable replacement service has been inaugurated and requesting proposals from carriers interested in providing replacement essential air service at the community. American Eagle has reduced its service during that time. In these situations it is difficult to determine cause and effect, i.e., did declining traffic levels cause the reduction in air service or did the service reductions cause the decrease in passengers? American Eagle served Ponce with 12 nonstop round trips a week in 1997 and 10 nonstop round trips a week most recently. Ponce is a major community of 200,000 residents, 80 miles from San Juan. The close proximity of a major hub such as San Juan would normally favor frequent service with small aircraft. However, American Eagle's smallest aircraft in the Caribbean is the 46-seat ATR 42.

Scheduled foreign air transportation of persons, property, and mail between the United States and France. Northwest intends to operate its services via Italy pursuant to a code-share arrangement with Alitalia. American intends to operate its services via the United Kingdom and Brussels, Belgium, pursuant to code-share arrangements with British Airways and Sabena, respectively.
Northwest Airlines filed an answer to American's application and American filed a reply. Northwest opposes American's application until the Department has granted the application of Northwest and Alitalia to conduct U.S.-France third-country code-share services. American responded that nothing prevents the Department from granting the applications of American and Northwest at the same time.
We have decided to allocate Northwest one of the two additional partnerships currently available for allocation to designated U.S. carriers, so that Northwest can provide third-country code-share service in the U.S.-France market with its partner Alitalia.' In addition, we have decided to allocate to American the third designation available for U.S.-France third-country code-share services with its partner, Sabena. Both of these requests are within the scope of authorities available under the U.S.-France aviation agreement and will expand the range of service options available to consumers. Our authorization in this notice of Northwest's U.S.-France code-share services with Alitalia addresses the concern raised by Northwest in its answer to American's application. As a result of our authorizations here, one additional code-share partnership opportunity remains available for allocation among the three U.S. carriers designated to provide third-country code-share service in the U.S.-France market. In this regard, we have deferred action on American's application to the extent that it seeks allocation of the remaining code-share opportunity to provide service in the U.S.-France market with British Airways. American's request is contingent upon approval by the Department of a related application of American and British Airways in Docket OST-99-6507 to engage in code-share services, including services in the U.S.-France market. That application is currently pending.

In its motion Continental urges the Department to strike United's exhibits and dismiss United's application in this proceeding. By so requesting, Continental hopes to turn United's unintentional forecasting errors to its advantage. Recognizing that it cannot prevail on the merits against United's superior application for service at Los Angeles, Continental resorts to procedural objections in an attempt to win by default. While the actions it urges would enable Continental to become the fourth nonstop carrier at New York, they would come at the expense of the far greater benefits United proposes to offer at Los Angeles, the largest U.S. market without nonstop service to Buenos Aires. United, therefore, urges the Department to deny Continental's motion for the reasons discussed below.
