Hereby request the Department to renew the statements of authorization issued by Notice of Action Taken dated February 18, 1999, and which will expire on February 18, 2000, that authorize Air Canada and Mexicana to code-share with each other on a Mexico City-Chicago-Toronto/Montreal/Ottawa/ Winnipeg routing. Air Canada and Mexicana also request that these statements of authorization be amended to include authority for the carriers to offer code-share services between all Air Canada transborder gateways (Montreal, Toronto, Ottawa, Winnipeg, Edmonton, Vancouver, Calgary and Halifax), via any U.S. point or points, to any point in Mexico served by Mexicana, on a blind-sector basis. Although Air Canada and Mexicana are seeking blanket approval for Canada-U.S.-Mexico code-sharing services, Appendix A contains an illustration of the specific U.S.-Canada and U.S.-Mexico city-pair sectors to be served by the carriers.

For all the reasons stated above, the Borough President's Office requests that ATA's application be denied in its entirety. The applicant has not presented a compelling case under the controlling laws in support of its application, particularly when one considers the negative impact that any new flights at LaGuardia would have. While a strategy to add flights at LaGuardia might fit within ATA's business plans, that strategy is not necessarily consistent with the slot exemption requirements imposed by Congress. If DOT is not inclined to deny the application outright on the grounds that ATA has simply failed to meet the applicable statutory requirements, then the Borough President's Office requests in the alternative that DOT do the following: postpone a decision until Congress acts on the FAA reauthorization bill and, in any case, commission a substantive and comprehensive environmental impact study with respect to LaGuardia.

Aeromar is currently operating transborder flights between San Antonio, Texas (SAT), and San Luis Potosi/Guadalajara, Mexico. Aeromar plans to continue those services and intends to institute passenger and/or all-cargo services in the SAT-Puerta Vallarta (PVR) market in the near term and San Antonio – Saltillo later this year. For flexibility to respond to demand, Aeromar seeks renewal of those San Antonio segments where it may not operate direct service in 2000. Nonstop service between Puebla and Houston and Queretaro - Houston with Aeromar-operated aircraft is planned for the fourth quarter of 2000. Aeromar seeks the necessary authority so that it can code share on Aeromexico-operated flights on this segment and thus offer single carrier service from Queretaro and Puebla to Houston with a stop and plane change in Monterrey.

United seeks leave to file to address issues raised by Continental and Delta relating to their proposed bifurcation of the procedures for allocation of U.S. -Brazil frequencies. These carriers are in effect seeking reconsideration of the Department's Order 99-12-27. United's response will clarify its position and provide a more balanced record on which the Department can reach a decision.
