Delta strongly opposes the grant of any extrabilateral authority to Aer Lingus. The Government of Ireland's steadfast refusal to lift the Shannon stop requirement for U.S. carrier service to Ireland is one of the most significant bilateral restrictions existing in Europe today. The Shannon stop requirement exacts a large financial penalty on U.S. carriers seeking to serve Dublin by forcing them to provide uneconomical Shannon service, which is not supported by demand. Unless and until the Government of Ireland is willing to negotiate a lifting of this restriction, no extrabilateral authority of any sort should be granted to Irish carriers.

Scheduled foreign air transportation of property and mail between point or points in the United States, via intermediate point(s), and a point or points in Argentina, and beyond. Challenge also requests authority to combine this exemption with Challenge's existing certificate and exemption authority. Challenge initially proposes to use this authority to provide service between Miami and Buenos Aires via Sao Paulo, Brazil. Challenge notes its pending application to transfer its other Latin American route authorities to United Parcel Service (UPS) (Docket OST-99-6345), as well as UPS' application to serve Argentina (Docket OS'l99-6391). Challenge states that it plans to continue operating the proposed Miami-Sao Paulo-Buenos Aires service until such time as UPS obtains the necessary Department of Transportation and foreign government approvals to operate in its own right. The authority to serve Brazil is at issue in the UPS/Challenge route transfer application which is currently pending. The Department granted UPS' Argentina application by notice of action taken dated January 12, 2000.

Order 2000-1-10 proposes to establish new intra-Alaska bush service mail rates for the period April 1, 2000, through March 31, 20001. The rates that are currently in effect were established by Order 99-4-11, served April 12, 1999, for the period April 12, 1999 through March 31, 2000. Those rates will remain in effect as final rates through March 31, 2000, or until a final order is issued with respect to the rates proposed here, whichever is later. All interested persons are directed to show cause why the Department should not adopt the foregoing tentative findings and conclusions and fix, determine and publish the proposed final rates specified. Objections due March 3, 2000.

Beginning on April 1, 2000, or as soon thereafter as practicable,, the Joint Applicants plan to conduct code-share operations in the city-pair markets listed in Attachment A hereto. The Joint Applicants will undertake to notify the Department no later than 30 days before commencing any additional code-share service pursuant to the blanket authority requested herein. Specifically, the Joint Applicants will inform the Department as to the market(s) to be served, the identity of the carrier that will operate the aircraft and all carrier designator codes to be displayed on a particular flight, and the date(s) on which code-share service will commence.

The most recent round of U.S.-U.K. negotiations ended last week without reaching an agreement that would permit any new U.S. carrier services to operate at Heathrow. Accordingly, there is no bilateral basis to support Northwest's request. If and when additional opportunities become available for U.S. carriers to serve Heathrow, Delta will submit an application for Heathrow services. To the extent such Heathrow opportunities are limited, the Delta and Northwest requests would be mutually exclusive. Northwest's tiling here gives it no precedence in any comparative selection proceedings. The Department's long-term goal with respect to U.S.-U.K. bilateral negotiations has been the achievement of a comprehensive open skies agreement that accommodates the Heathrow service objectives of all U.S. carriers. Delta supports this long term objective. However, should the Department conclude a more limited agreement in the near term, there is no basis to support Northwest's claim of special "Heathrow entitlements" for Detroit and Minneapolis/St. Paul (Northwest application, p. 1, fn. 2). The Department would need to consider the needs and merits of all competing carrier/gateway proposals, and, should such opportunities actually arise, Delta will demonstrate the superiority of its Heathrow proposal.

Northwest itself has stated that it believes that the "U.S. Government must maintain its focus on obtaining a comprehensive, fully-liberalized agreement" rather than "pursuing piecemeal openings of the U. While the focus of the Pro Air application is on increased operations at LGA, the Secretary must be mindful of the effect his decision will have on the proposed city pair and the people living in the residential communities around DET. Low flying jet traffic over one's home, even by Stage 3 aircraft can be disruptive to normal family life. Many of the communities around DET were established long before that airport was first developed in 1927. The vast majority of the current residents purchased their homes at a time when DET served only general aviation traffic. This is not a situation commonly found elsewhere of development encroaching nearer and nearer to a busy jet airport and then the homeowners complaining about the noise. Rather, this is a case of jet operations intruding on existing, otherwise quiet, communities. Before the Secretary imposes that cost on the individuals residing around DET, he should be certain that the benefits to society are greater.
