By Order 99-12-27, the Department reestablished the procedural schedule for the 1999 U.S.-Brazil Combination Service Case, Docket OST-99-6284 (1999 Brazil Case). That order also directed Continental to submit evidence of its plans to use three of the seven weekly frequencies currently allocated to Continental for service in the Houston-Sao Paulo market before .they would become dormant under the terms of their award. Absent such evidence the Department stated that it would consider whether it is in the public interest to place those frequencies at issue in the 1999 Brazil Case. On January 7, 2000, Continental filed its response to the Department's order. In addition, on that same date Continental Airlines filed an application (Docket OST-2000-6759) for exemption authority to operate service on a Houston-Lima-Sao Paulo routing beginning June 15, 2000, an exemption from the dormancy conditions on three of its seven Houston-Sao Paulo frequencies until June 15, 2000, and an allocation of three weekly Peru-Brazil fifth-freedom frequencies so that Continental can offer local Lima-Sao Paulo service on its Houston-Lima-Sao Paulo flights. Because the Houston-Lima-Sao Paulo application is related to Continental's response in the 1999 Brazil Case, Continental requests that the Department shorten the period for filing answers to its application to January 13, 2000, the same date that answers to Continental's response in Docket OST-99-6284 are due. (Under the Department's regulations, answers to Continental's application in Docket OST-2000-6759 would normally be due January 24, 2000).
Acting under assigned authority under 14 CFR Part 385, we have decided to grant Continental's request to shorten the period for filing answers to its application in Docket OST-2000-6759. Given the interrelationship between Continental's application and the outstanding issues in the 1999 Brazil Case, and our desire to make a final decision as to the scope of the 1999 Brazil Case as soon as possible, we believe that the public interest is best served if interested parties file answers to Continental's January 7 application on the same date that answers are due to Continental's response in the 1999 Brazil Case.--Carriers may file separate answers to the application or may file a consolidated response to both pleadings. We believe that this modification to the normal procedural schedule balances the needs of all interested parties, while ensuring that the Department has a complete record on which to consider the matters at issue.

Ninety Day Notice to Terminate Essential Air Service at Mattoon, Illinois |
Order 2000-1-11 requires Great Lakes Aviation, Ltd., d/b/a United Express, to maintain essential air service at Mattoon, Illinois, as set forth in Appendix D of Order 99-11-11, for an additional 30-day period through February 21, 2000, or until a carrier capable of providing reliable replacement service actually begins service, whichever comes first.

Harlequin Air seeks renewal of the exemption in order to maintain its charter service between points in Japan and points in the United States. Harlequin Air has the necessary operating authority from the Civil Aviation Bureau of Japan to perform international charter operations. This service is consistent with the Civil Air Transport Agreement between Japan and the United States, signed August 11, 1952, as amended, and with the Memoranda of Understanding signed by representatives of the United States and Japan on November 6, 1989 and April 20, 1998. Harlequin Air's service enhances the Japan-U. S. charter market to the benefit of the U.S. economy and increases tourism. Renewal of Harlequin Air's exemption is therefore in the public interest.

Legend has invested a significant amount of resources in anticipation of its start-up of passenger operations in February 2000. The initiation of Legend's operations has been delayed by an unprecedented assault on its proposed operations before the Department; and in state and federal courts. Despite federal law and clear Departmental rulings on its right to operate, Legend has had to counter those opposed to any level of competition in multiple forums. Legend has hired and trained the personnel necessary to operate, and has the requisite operational personnel and plans in place to begin its service. Further, in preparation for advertising and selling tickets, Legend has: (a) made arrangements to list and sell tickets through the Sabre, Galileo and Worldspan computer reservations systems; (b) staffed and initiated training of its reservations center; (c) retained an advertising agency; (d) contracted for web-site development and online ticketing capabilities; and (e) hired an in-house marketing staff, headed by Lisa Bauer, Senior Vice President of Sales, Marketing and Customer Service. Ms. Bauer was previously with Midwest Express Airlines. In light of the extraordinary efforts to stop Legend from operating, it is imperative that Legend be permitted to begin advance ticket sales for its initial flights and thereby increase the likelihood of success of its start-up service.

In 1998, the European Commission proposed conditions on United's alliance with Lufthansa and SAS that would deny United rights guaranteed under various bilateral aviation agreements, giving rise to United's complaint pending in this docket. Since that time, a new Commission is in place and is undertaking a review of the issues prompting United's complaint. High level discussions between U. S. Government officials and the relevant Commission Directorates are scheduled to take place within the next two months. In order to underscore the U.S. Government's resolve to reach a satisfactory resolution of this matter that preserves U.S. carrier rights under existing bilateral aviation agreements while continuing to facilitate a negotiated settlement, United believes that a further limited waiver of the statutory deadline to act on United's complaint is in order. Accordingly, United respectfully requests that the Department extend the deadline for acting on United's complaint in this matter to April 24, 2000.

Notice advising that the Department will grant immediate interim access to all documents covered by the Rule 39 Motions to counsel and outside experts for interested parties who file appropriate affidavits with the Department in advance.
