By this exemption request, Aeromexico seeks renewal of its exemption authority to engage in scheduled foreign air transportation of persons, property and mail between Monterrey, Mexico, and Laredo, Texas. Although Aeromexico has not instituted nonstop service in the market, it desires to retain the exemption authority so it can provide such service when market conditions warrant. In addition, when service is instituted, Aeromexico plans operate with Metro III or similar aircraft, under a wet lease arrangement with Aerolitoral, S.A. de C.V., an affiliate of Aeromexico. Contemporaneously herewith, Aerolitoral is filing an application seeking renewal of its Statement of Authorization to conduct such wet lease operations.

The only issue raised on the record concerned Milan's Linate Airport. Specifically, United Air Lines, Inc., filed an answer stating that, since Linate Airport is scheduled to close to international traffic, the Department should condition any authority granted to Alitalia/KLM/Northwest so that they could not offer monopoly online code-share service to Linate Airport that other U.S. carriers would be precluded from offering because their European partners would be barred from serving that airport, ' The applicants filed a joint reply stating that the Government of Italy's policy to place all international services, including Alitalia's, at Milan's Malpensa Airport and to limit Linate Airport service to a few domestic Italian sectors is nondiscriminatory and has been examined and approved by the European Commission. United filed an additional pleading reemphasizing its position. (We granted all motions for leave to file.)

We have decided to grant the requested statements of authorization. We found that our action was in the public interest and consistent with the provisions of the U.S.-Italy aviation agreement. With respect to United's concerns, we note that the Government of Italy has postponed implementation of its policy limiting access to Linate Airport, and that we accordingly see no need now to impose the suggested condition. We reserve the right to review the matter when and if the Government of Italy's policy regarding Linate becomes effective.

The unaudited trial balance sheet contained in Appendix A to this application supplement and dated September 30, 1999 reflects the financial position of Spernak Airways, Inc. as of that date and is consistent with the quarterly financial documents submitted with the Spernak Airways, Inc. initial application (dated and submitted to the Department on November 8, 1999). Spernak Airways, Inc. modifies its proposal for scheduled service to more accurately reflect the volume of scheduled flights, extra sections, and charter activity in the markets of Tyonek and Beluga. As a result, it is increasing the frequency of service in its proposal and is eliminating any projections for extra section flight activity. It is assumed that any excess demand in the market beyond the proposed scheduled service will be accommodated on a charter, on-demand basis and the projection for total Company operations reflects this assumption. Therefore, Spernak Airways, Inc. proposes to use a Cessna 207 aircraft at the time service is inaugurated from the terminal point of Anchorage to the intermediate points of Tyonek and Beluga and return to the terminal point of Anchorage, two scheduled flights each day, 5 days per week. The description and projected financials for this proposal are contained in Appendix B to this supplement.
