Carrier is an Ad Hoc all-cargo charterer. Intends to use L-188 equipment.

The Department is revising its rules governing airline computer reservations systems (CRSs) to change the rules' expiration date for a second time. This revision changes the date from March 31, 1999, to March 31, 2000, to keep the rules from terminating on March 31, 1999. The rules will thus remain in effect while the Department continues out its reexamination of the need for CRS regulations. The Department finds that the current rules should be maintained because they are necessary for promoting airline competition and helping to ensure that consumers and their travel agents can obtain complete and accurate information on airline services. The Department previously extended the rules from December 31, 1997, to March 31, 1999.

If the exemption is granted DHL proposes to operate a service between Cincinnati/New York and Bahrain via Brussels five days per week in each direction by way of code-sharing with other carriers on their existing services. Between New York and Brussels, DHL would operate under a code-share agreement with Gemini Air Cargo, a U.S. air all-cargo carrier authorized to operate between New York and Brussels and currently offering service in that market. Under the code-share agreement, DHL's airline designator code ("ER") would be added to that of Gemini for its flights in that market. The aircraft operated by Gemini Air Cargo is a DC-10. Between Brussels and Bahrain DHL would operate under a code-share agreement with DHL International EC, a non-U.S. air carrier authorized to operate between these points and currently offering service in that market. DHL International EC will in due course submit an application for exemption and for a Statement of Authorization to enable it to add DHL's "ER" code to DHL International EC's flights between Bahrain and Brussels. The flights between Bahrain and Brussels are operated for DHL International EC by Nordstress Australia Pty., Limited. The aircraft operated by Nordstress is a B-757.

By this order, we make final, except to the extent noted, our tentative findings and conclusions in Order 98-12-33 and award the seven available frequencies for U.S.-Brazil services to Continental Airlines, Inc. for Houston-Sao Paulo service and select Delta Air Lines, Inc. as a backup carrier for New York-Sao Paulo service.
