Canadian Airlines International Ltd. hereby submits this Supplement to its Application for six (6) exemption slots at Chicago O'Hare International Airport to operate three (3) additional daily flights between Chicago O'Hare International Airport and Edmonton., Calgary and Vancouver commencing the start of the summer 1999 season (April 4, 1999). This Supplement consists of letters of support for the proposed service by the following: Honorable Ralph Klein, Premier of Alberta; Honorable Walter Paszkowski, Alberta Minister of Transportation and Utilities; and Mr. Scott Clements, President and CEO of Edmonton Regional Airports Authority

Although there has been no formal declaration, it is fairly clear that the Department is holding Cielos hostage as leverage in its attempt to gain access for Fine Air to the U.S.-Peru market. As the Department well knows, Fine Air's difficulties began in early 1995 when it transported arms from Argentina to Ecuador during a period of hostilities between Ecuador and Peru. Fine Air's participation in the movement of the arms was viewed by Peru most seriously as an act that endangered the national security of the country. The Department itself recognized the seriousness of the event and found that the actions taken by Peru against Fine Air were reasonable. Order 96-7-5. Nevertheless, the Department continues to carry Fine Air's banner at the expense of both Cielos, which has done absolutely nothing to warrant being denied the opportunity to expand its U.S. operations, and Peruvian aviation interests.
The next obstacle to resumption of operations by Cielos apparently has been raised by the FAA. As we understand it, the Department normally does not act on applications by foreign airlines for new authority until the International Liaison Branch (AFS-50) of the Flight Standards Service indicates that a grant of authority is acceptable. To date, the FAA has not signed off on Cielos' application, apparently due to some undefined concern that the FAA has with the safety oversight being exercised by the DGTA over Peruvian airlines. The fact is, however, that Peru has been found by the FAA to be in compliance with ICAO standards and, accordingly, has been classified as Category I under the International Aviation Safety Assessment program. Cielos currently is operating, although not to the U.S., and is doing so without safety incidents, which attests to the adequacy of Peruvian safety oversight. Consequently, the FAA should support a grant of exemption authority to Cielos.

Atlanta - Rome |
Exemption under 49 U.S C. 40109 to the extent necessary for pendente lite authority to permit Delta to commence the sale and marketing of Atlanta-Rome nonstop service, pending final award of Department authority to serve the Atlanta-Rome market.
By Order 99-2-27, the Department tentatively selected Delta to provide nonstop service between Atlanta and Rome in the 1999 U.S. -Italy Combination Service Case. Delta requests immediate issuance of pendente lite authority to enable Delta to continence the sale and marketing of Atlanta-Rome nonstop service for the coming summer season, pending issuance of a final order in this proceeding. Delta maintains that special circumstances warrant the issuance of pendente lite authority' saying that awaiting issuance of a final decision in this case would place Delta at a competitive disadvantage because other U.S.-Italy carriers are currently selling their peak travel season U.S.-Italy services.

The nature of the transaction in issue and the basis for the Department's approval thereof are amply set forth in the transfer application, which is incorporated herein, and need not be repeated here. Briefly, upon consummation of the transaction, Fine Corp will control Arrow and Fine Air. These companies will be operated as independent entities. Unexpectedly, the Federal Trade Commission recently granted early termination of the waiting period under the Hart-Scott-Rodino Antitrust Improvements Act and, but for the necessary Department approvals the transaction is ready to close. Since it is highly unlikely that the transfer application will be acted upon in time to permit closing in accordance with the currently projected timetable, Joint Applicants request a temporary exemption from 49 U.S.C. §41105, so the closing may take place as soon as possible.
