AAir Exel is a Dutch carrier that has established a marketing arrangement with KLM that includes codesharing operations, shared ground-handling and common schedule planning. Under its strategic arrangement with KLM, Air Exel will operate the Amsterdam-Antwerp route, adding the code of Northwest to Air Exel's service for the purpose of transporting Northwest's U.S.-originating and U.S.-destined traffic. Codeshare service will begin on March 28,1999.

The ownership of Aviones Are changed with the death of Manuel Espinosa Rugarcia, who held 25% of the company's capital stock. Mr. Espinosa's estate has redistributed these shares and the current ownership of Aviones Are is as shown in Exhibit B. All shareholders of Aviones Are are citizens of Mexico.

This application is a nearly verbatim reiteration of Colgan's November 1997 application which was denied by the Department. In rejecting Colgan's request for slots at that time, the Department noted that while there were transportation benefits to the proposed service, the granting of slot exemptions "would not fill voids, but would merely enable an expansion of incumbent carriers' existing operations, and do not promise a significant enhancement of price competition."' The Department further noted that there was no showing of a "material deficiency of service in any of the markets ...[nor any evidence of] substantial competitive price benefits that [Colgan was] not already in a position to offer." Colgan's proposed service would do little to enhance any of the factors Congress specified that the Department consider in evaluating what was in the public interest. These factors include maintaining safety; enhancing low-priced services; encouraging fair wages and working conditions; increasing competition; encouraging the use of secondary or satellite airports in major urban areas; preventing anticompetitive practices; avoiding market domination by a single carrier; and providing low prices.

hereby applies to the Department of Transportation for an exemption from Section 41301 of the Code to enable it to conduct charter foreign air transportation of persons, property, and mail between Japan and the United States, and other charters subject to Part 212 of the Department's rules. JAZ's previous exemption authority expired on December 1, 1998; a renewal application inadvertently was not filed. JAZ's charter services are authorized under the 1998 Memorandum of Understanding between the Governments of Japan and the United States and subsequent amendments. Renewal will allow JAZ to continue to offer important charter services between the two countries. In addition, by providing charter service for numerous Japan-originating passengers to the United States, JAZ affords significant economic benefits and conveniences to the traveling public and to the U.S. communities JAZ serves. Accordingly, grant of this exemption is clearly in the public interest.

SACSA added two aircraft to its fleet, a seven passenger Sabreliner 60 with Mexican registration XA-ICK and a nine passenger Lockheed Jetstar 8 with Mexican registration XA-SOC. SACSA's fleet now consists of six executive jet passenger aircraft.

Pursuant to the authority granted above, TWA has instituted code share service with Royal Jordanian. TWA currently provides service on the New York - Amsterdam -Amman routing five times weekly. It has been unable to institute service to India because of difficulties with the Government of India, which has refused to accept assurances by Jordan that it would allow code share operations by Indian carriers. TWA is working with the U.S. Government to resolve this problem. TWA has instituted service to the other code share points beyond Amman, except for Aqaba, where current service does not provide useful connections. TWA, nevertheless requests renewal of the Aqaba authority because it is working with Jordanian to improve connections and my place its code on the Amman - Aqaba flight within the next few months.
