The American/JAL request for statements of authorization generally mirrors the scope of authority issued to United/ANA. As such, it should be granted subject to the same conditions imposed on United/ANA, including the condition that American/JAL notify the Department no later than 30 days before they begin any new code-share service under their statements of authorization. American and JAL already have provided notice of their intention to implement Phases 1 and 2 of the code sharing under their agreement. In later phases, American and JAL plan to code share to hundreds of additional points. Because the Department has determined that, effective February 22, 1999, code-share applications will be filed in the public docket, the Department also should require that all carriers' 30-day code-share notifications be filed in the public docket to provide interested parties actual notice of new code share implementation. The American/JAL agreement does not presently contain an exclusivity provision. United has urged that such provisions be allowed, but the Department has undertaken a review of that position as well as of United's exclusivity provision in its code-share agreement with ANA. Depending on the outcome of the Department's review, American and JAL may later adopt such a provision. The Department should, therefore, require that they submit any such provision to the :Department for review.

By this application, Challenge requests authority to enable it to serve Peru, Venezuela and Brazil from additional gateways in the United States. In the case of Peru. Challenge asks that its authority be expanded to encompass the new route description set forth in the newly executed "Open Skies" agreement between the U.S. and Peru. In the case of Venezuela and Brazil. Challenge requests that its authority be expanded to permit Challenge to operate (via any authorized intermediate points and to any authorized beyond points) from Dallas/Ft. Worth. This application is prompted by a recent decision by Challenge to establish Dallas/Ft. Worth as a second hub for Challenge's services to Latin America. For many years. Challenge has served Latin America via its hub in Miami. However, as trade and commerce between the United States and Latin America has continued to develop and evolve. it has become clear that there is a burgeoning demand for scheduled all-cargo service to/from Latin America at other gateways in the United States. In recognition of this fact, Challenge is establishing a pattern of service linking Dallas/Ft. Worth with various Latin America destinations.

Scheduled foreign air transportation of persons, property and mail under a code-share arrangement with Air France between Houston and Newark. on the one hand. and Moscow and St. Petersburg, Russia, on the other hand, via Paris. Continental also applies for allocation of seven weekly U.S.-Russia code-share frequencies from among those now unused by American, Baltia. Delta and United and available for reallocation.

Continental asks for allocation of seven weekly U.S.-Russia frequencies to enable it to place its code on seven weekly Air France flights between Paris and Moscow and seven weekly Air France flights between Paris and St. Petersburg. Awarding seven of the unused weekly U.S.-Russia frequencies to Continental will enable the Department to promote code-sharing between the U.S. and Russia under the new U.S.-Russia bilateral aviation agreement. Continental will be able to compete for the first time with U.S. and Russian carrier services and with U.S.-Russia code-share arrangements involving other carriers.

The Office of Secretary is withdrawing its rulemaking proposal to revise the on-time flight performance reporting requirements. The Department had proposed to re-establish the exclusion of flights delayed or cancelled due to mechanical problems. This withdrawal of the rule is taken in response to comments made to the notice of proposed rulemaking by consumer groups, safety experts and various airlines.
