OST-98-4890 January 6, 1999 pdficon.gif (87 bytes)Reply of Japan Airlines High Density Rule - Chicago O'Hare document.gif (123 bytes)HTML

Delta's opposition to JAL's application is a weapon of the bluntest sort and DOT should decline Delta's invitation to use it. The remedy Delta seeks against JAL is neither proportional nor relevant to the problem Delta would like to see' resolved. Accordingly, JAL asks the Department to deny Delta's request for deferral and to grant JAL's exemption request forthwith.

In the event that the Department, contrary to United's position set forth above, should decide to uphold the objections of American and Delta, the same action should be taken in equal measure with respect to both Japanese carriers. No party to this proceeding has suggested otherwise except by implication. United, therefore, reserves the right to submit further comment should any party suggest discrimination as between the two Japanese carriers applications.

OST-97-2786
OST-97-2787
January 6, 1999 pdficon.gif (87 bytes)Motion of Pan American to Dismiss Joint Application Approval of Transfer of Route Authority and Exemptions

On June 29, 1998, Pan Am and Carnival, and various other affiliated corporations, were acquired by PAL pursuant to a Chapter 11 Plan of Reorganization confirmed by the U.S. Bankruptcy Court for the Southern District of Florida, Miami Division. PAL submitted a formal notification of that acquisition with various pertinent information and documents, pursuant to Section 204.5 of the Department’s Economic Regulations, on June 30, 1998. PAL is now the sole owner and corporate successor-in-interest to Pan Am and Carnival. Pan Am ceased operations on February 4, 1998 and has surrendered its FAA Part 121 Operating Certificate. Ongoing charter operations are being held out, sold and conducted by Carnival which now does business under the name Pan American Airways Corp.

As a result of the foregoing transactions and developments, PAL submits that the matters at issue in the Section 41105 route transfer proceeding are now moot. Accordingly, PAL hereby moves the Department to dismiss the pending Joint Application in Docket OST-97-2787 on the ground of mootness. The exemption application in Docket OST-97-2786 has been concluded by Order 97-9-3 and no longer remains pending.

In conclusion, based on the submissions of Delta, Trans World Airlines believes that it has not been paid a fair and reasonable rate for mail transportation for the past two years in the Atlantic Rate Area; that the rates proposed in Order 98-11-18 are not fair and reasonable; and that the Department should ignore the data provided by Delta when determining international mail service rates.
