Although scheduled air transportation between the U.S. and Hong Kong is governed by an air services agreement, cargo charter services are not within the purview of the agreement; rather, cargo charter service is governed by comity and reciprocity. In granting the original permit to AHK, the Department found that "adequate comity and reciprocity and our overall aviation relations with Hong Kong support favorable action on AHK's request." AHK is not aware of any circumstances that would warrant a change in those positive findings.

Withdrawal of Objection of Northwest Airlines

Northwest Airlines, Inc. ("Northwest") hereby withdraws its objection to the Renewal of Exemption filed by Air-India Ltd. ("Air-India") in the above-captioned Docket. Subsequent to Northwest's Answer in this proceeding, filed on April 21, 1997, the Government of India confirmed through diplomatic channels its intention to permit Northwest/KLM to engage in U.S.-India thirdcountry code-share services, via Amsterdam, pursuant to the terms of the U.S.-India bilateral, as amended. Northwest therefore hereby withdraws its objection to the above-captioned renewal application of Air-India. Northwest fully supports renewal of Air-India's authority and urges the Department to act upon Air-India's renewal application in a timely fashion.

Balkan Bulgarian Airlines (Renewal and Amendment of Exemption, Sofia via Split - New York)

This summer BBA plans to operate three weekly flights between Sofia and New York. This will include a weekly nonstop as well as the existing one-stop service via Malta. In addition, BBA intends to operate a new weekly Sofia-New York service via Split, Croatia, according to the attached schedule, beginning June 17, 1997. Under its proposed routing, BBA's Tuesday flights would operate from Sofia to New York via Split, Croatia, and will return from New York to Sofia via Split. This will provide a weekly roundtrip flight between New York and Split, Croatia, a city pair not served by any other carrier.

The Department's precedents in this regard have been clear, and KAY is clearly wrong when it contends that approval of its renewal application is warranted under governing principles of comity and reciprocity.

As the primary commercial service airport serving a 19county region with a population of more than 700,000, the resumption of nonstop Roanoke to Chicago O'Hare service would mark a welcome return of convenient access to this region's third largest air travel market.

Even if Northwest is allowed to amend its service plan, the new all-cargo schedules it proposes for its U.S.-Philippines services merely confirm the superiority of United's proposal. Both of United's new U.S.-Philippines all-cargo services would operate to Manila on a turnaround basis. This would provide direct services twice weekly between Manila and the U.S. in both directions. Northwest's new proposal would offer only a single turnaround flight at Manila. The other weekly frequency would serve Manila in the eastbound direction only. Any westbound freight from the U.S. to Manila on that service would be carried via Bangkok, adding a considerable amount of elapsed time for U.S. shippers.
