Northwest Airlines has polled the U.S. carriers named in the service list attached to the above-referenced exemption application. Delta Air Lines is the only carrier that has expressed its intent to object to the exemption application. Although Delta apparently does not intend to file its answer before answers would normally be due under the Department's procedural regulations, Northwest understands that Delta would be willing to file its answer earlier if the Department established a shorter answer period in this proceeding.

One airline Northwest Airlines—currently dominates the market for air transportation to and from Detroit and southeast Michigan. Northwest accounts for more than 75 percent of the enplanements at Detroit Metro, and new entry is constrained both by the absence of gates available for lease on reasonable terms and by fear of Northwest's overwhelming—if not predatory—response to new entry. As a result of Northwest's dominance and the absence of competition Detroit is one of the most expensive cities in the nation to fly to and from, because Northwest Airlines dominates local air travel. The July issue of Consumer Reports magazine ranked Northwest as the highest-priced major carrier, based on 1996 US DOT data. Metro is among the nation's four most-expensive airports, based on the cost per mile for flights up to 300 miles and 301 to 750 miles.

US Airway's complaint underscores the concerns expressed by Delta and others about the highly restrictive conditions applicable to U.S. carrier access to London's airports, the impact of those restrictions on the Department's consideration of the joint application of British Airways and American Airlines for approval of an antitrust immunized alliance, and the importance of addressing London airport access problems in bilateral negotiations with the U.K. The United Kingdom now has the distinction of being the largest and most restrictive U.S. bilateral aviation regime. The Bermuda II agreement severely restricts the number of authorized U.S. carriers, the airports they can serve and the capacity they can offer. Wholly apart from the bilateral agreement, there are de facto barriers to entry at London's airports due to the lack of airport slots and facilities.
