Answer of The City and County of Denver
Denver's position is that it would be completely unfair to impose sanctions on Denver, which has no London service, for an unrelated dispute that has nothing whatsoever to do with Denver's need for access to Europe. U.S. Airways, in Docket OST-98-3615, expressed its commendable concern for the people of Charlotte by asking that British Airways' service to that city not be suspended. The people of Denver are no less worthy of London service. Respectfully submitted,

Kenya Airways and Northwest believe the procedure recommended above would address the concerns of United relative to future service in markets where United or other carriers might express an interest. At the same time, the procedure would provide the flexibility for Kenya Airways and Northwest to implement new services in U.S.-Africa markets without the lengthy delays, and additional costs, involved in repeated applications filed with the Department.

Reply of Korean Air Lines to Answer of World
Airways
When stripped of its rhetoric, World's answer does not raise any issues that have not already been addressed by the Department in dealing with several applications submitted by KAL in the last twelve months or so. The fundamental thrust of World's objection is its claim that the Government of the Republic of Korea has not allowed World to institute new scheduled all-cargo service in the U.S.-Korea market with beyond service from Korea to Malaysia. While KAL does not have firsthand knowledge of the discussions between World and the Korean civil aviation authorities regarding this matter, KAL understands that the service proposed by World would have replaced a service that was previously operated by a non-U.S. carrier pursuant to a wet lease agreement with World. KAL also understands that the Korean Government raised what appear to have been legitimate questions regarding such an operation and -- more than a year ago -- requested additional information from World regarding the proposed new service. KAL further understands that World has yet to respond fully to the Korean Government's request.

Application for Emergency Exemption
Polynesian Limited ("Polynesian") hereby requests an emergency exemption from 49 U.S.C. 41301 and from any other provisions of Title 49 and the Economic Regulations of the Department of Transportation ("Department") to the extent necessary to permit it to engage in the scheduled foreign air transportation of persons, property and mail between Maota, Samoa and Pago Pago. American Samoa. Polynesian requests that any exemption granted by the Department pursuant to this application remain in effect tor a period of at least one year. Polynesian intends to commence service between Maota and Pago Pago on March 20, 1998.

Uzbekistan Airways (Foreign Air Carrier Permit and Exemption)

UZB respectfully amends its Application for Issuance of a Foreign Air Carrier Permit to incorporate the rights detailed above as provided in the new Open Skies Agreement between the U.S. and the Republic of Uzbekistan. UZB further requests that, on the basis of the foregoing as well as UZB's original application, a foreign air carrier permit incorporating the requested authority be issued promptly, and that the Department grant such other and different relief as the Department deems to be consistent with the public interest.

Answer of Atlas Air to Objections to Order
98-2-24
Atlas has proposed to provide daily B-747 freighter service in the Miami-Colombia market, and it will provide that service. The same business flexibility that supported its decision to enter the U.S.-Colombia market also supports its intent not to offer U.S.-Colombia scheduled service exclusively to any single consolidator. forwarder, or other customer. As the Department and Atlas's competitors are aware, there is a strong array of potential customers for scheduled U.S.-Colombia service, and Atlas can draw on its own customers and contacts in South America for business as well.

The fact that the Department did not have before it Fine Air's service proposal renders its assessment of the relative merits of Fine Air's application compared to Polar's application just as invalid as its assessment of the merits of Fine Air's application compared to Atlas's application. Applying the Department's criteria to the service proposals of all three carriers now on the record, Polar's application clearly ranks a distant third. Accordingly, there is no basis to conclude that Polar merits the designation that will become available in September 1998. Rather, if for whatever reason Fine Air is not awarded Millon's authority in the instant proceeding, Fine Air should be awarded the designation that becomes available in September 1998 on the basis of its clearly superior service proposal.

Polar, unlike Fine, has requested the award of the September 1, 1998, U.S.-Colombia all-cargo designation in the event the Department decides, contrary to both carriers' objections, to proceed with a final decision on the basis of the present record. The Department has already reached a tentative conclusion that Polar's proposed schedule of three weekly B747 round trips is superior to the services proposed by Fine. The amended proposal of Fine, submitted after the Department noted the defects of its original proposal, should not be considered by the Department for purposes of adjudicating between Polar and Fine for the reasons already discussed.

1998 U.S.-Japan Combination Service Proceeding

By this order, we have tentatively decided to (a) allocate 64 of the available 90 weekly frequencies available under the January 30, 1998 U.S.-Japan Memorandum of Consultations to American Airlines, Inc., Continental Airlines, Inc., and Delta Air Lines, I-nc., as set forth in this order; (b) authorize Trans World Airlines, Inc. to serve the St. Louis-Tokyo (Narita) market under the first new entrant opportunity and allocate it seven weekly frequencies for this service, (c) authorize Hawaiian Airlines, Inc., for services in the Maui-Tokyo (Narita) market commencing January 1, 2000, using the second new entrant opportunity and allocate it seven weekly frequencies for this service; and (d) allocate the 28 weekly frequencies for U S -Japan code-share services by U. S carriers equally to Trans World Airlines for its code-share services with Delta and to Continental for its code-share services with Northwest Airlines. We will afford interested parties ten days to object to our tentative decisions and seven calendar days for replies to any objections filed. Also, we have decided, by final action in this order, to allocate the 21 weekly frequencies available for beyond-Japan code-sharing services to Continental Airlines and Northwest Airlines for services beyond Japan to Seoul, Korea (or, alternatively. Taipei, Taiwan); Singapore; and Bangkok, Thailand.
