United's expressed concern about route integration appears to be principally related to United's perception of the circumstances of its own certificate and exemption authority (United Answer, p. 4). That concern does not appear to be applicable to Federal Express, which holds an exemption granting Federal Express broad world-wide operating flexibility to provide services between points on all of its certificate and exemption authorizations, subject to specificapplicable bilateral agreements (Order 98-1-23, served January 29, 1998). Federal Express respectfully requests that the Department issue an order amending Federal Express' Certificate for Route 205-F authorizing Federal Express to provide scheduled foreign air transportation of property and mail between points in the United States and points in Japan, via intermediate points and beyond Japan, as requested in its application, as modified in this Reply.

Petition of Rulemaking of the Air Transport Association of America on Policy Regarding Airport Rates and Charges

The ATA hereby petitions the Department of Transportation and the Federal Aviation Administration (collectively, 'DOT") to make certain revisions to DOT's Policy Regarding Airport Rates and Charges (the "Policy") in light of the decision of the United States Court of Appeals for the District of Columbia Circuit in Air Transport Association of America v. DOT, 119 F.3d 38. as amended bv 129 F.3d 62a (D.C. Cir. 1997). Now that the Court of Appeals has vacated and remanded certain portions of the Policy for further consideration and explanation, ATA urges DOT to promptly issue a notice of proposed rulemaking that addresses certain of the Court's concerns and will provide for more effective oversight over airport rates and charges, as Congress has mandated.

Air St. Martin ("Air St. Martin"), requests renewal of its exemption authority granted by Notice of Action Taken in Docket OST-96-2014, dated March 13, 1997, and confirmed in Order 97-7-19, which permits it to engage in charter foreign air transportation of persons and their property between points in the French West Indies and the United States, and to engage in other charters pursuant to 14 C.F.R. Part 212 of the Department's regulations. Air St. Martin requests that this exemption be renewed for an additional period of one year, from March 13, 1998 through March 13, 1999.

TWA hereby requests leave to file this Supplement to its Answer to Motions for Immediate Action as an otherwise unauthorized document in this proceeding. TWA filed its Answer on March 5, 1998 and discussed, inter alia, Northwest's control of 51.8% of the outstanding voting power of Continental. On the same date, Northwest filed an document.gif (123 bytes)SEC Form 8K with the Securities and Exchange Commission reporting that it had acquired an additional 979,000 shares, and that it now held 57.8% of the outstanding common stock voting power of Continental.

The Governance Agreement, dated January 25, 1998, among Continental, Northwest, and another corporation was also amended to allow Northwest's voting power in Continental to exceed 50.1% of the fully diluted voting power of Continental's voting securities. A copy of a news report on the Northwest filing is attached hereto.TWA requests leave to file this Supplement and the attached document as an otherwise unauthorized pleading. It corrects TWA's Answer to reflect the most current information and will assist the Department in its consideration of the Continental application for code share frequencies.

If the U.S. Government fails to take action, the it would effectively permit British Airways to perpetuate its current monopoly service between London and Charlotte, and to continue receiving its extraordinary benefits under Bermuda II (while new U.S. entrants like US Airways are being frozen out of London service with the U.K. Government's tacit approval despite their designation by the U.S. Government).
