Commander Mexicana's Third and Fourth Freedom charter authority is authorized by Annex II to the U.S.-Mexico Air Transport Agreement, and is therefore presumptively in the public interest. Commander Mexicana's Fifth Freedom charter authority is based on principles of comity and reciprocity, as is its relief from the advance approval requirement for transborder charter flights and any grant of stopover privileges. Commander Mexicana submits that continuation of these extra-bilateral authorizations is warranted given the harmonious state of aviation relations between the United States and Mexico.

The Department's failure to communicate to the parties the bases upon which it intended to select among competing applicants -- or even to seek information necessary to make that decision -- violates the requirements of due processor It is, moreover, inexplicable. No purpose is served by the Department's refusal to state clearly how it proposed to choose among interested carriers or soliciting information necessary to make that choice -- indeed, by remaining mum while carriers debate issues that, it subsequently turns out, the Department has decided to treat as irrelevant.

Objections of Polar Air Cargo to Order 98-2-24
Polar urges that the Department rescind its tentative findings and conclusions and direct all applicants to submit evidence relating to their proposed services such as that normally required in carrier selection cases involving scheduled all-cargo services. The resolution of serious issues surrounding the intended use of this authority by Atlas cannot otherwise be addressed. In the alternative, Polar requests the Department to issue a further order selecting Polar to provide U.S.-Colombia scheduled all-cargo service on September 1, 1998, pursuant to the designation opportunity available under the U.S.-Colombia bilateral air services agreement on that date.

Volga-Dnepr J.S. Cargo Airline (Renewal and Amendment of Exemption, Russia-US)

Answer of United Air Lines to Applications for
Renewal of Exemption
Given the current state of affairs, Volga-Dnepr's statement that its renewal request should be granted because initially it will benefit a U.S. carrier rings hollow. There are no immediate plans to implement Volga-Dnepr's wet lease with Evergreen. That service is delayed due to failure of VolgaDnepr and Evergreen to obtain approval from the Chinese government. Evergreen has not yet even requested a statement of authorization from the Department to operate this wet lease for Volga-Dnepr. In any event, the Department has not hesitated in the past to defer authority to Russian carriers which also benefits U.S. carriers, as witnessed by its refusal to approve the Transaero/American and Aeroflot/Continental code shares.
