Application for Emergency Exemption
Permit Antonov to operate a single one-way all-cargo charter flight transporting one (1) outsized thrust reverser inlet and up to eight (8) thrust reverser halves for Boeing 777 aircraft, one (1) thrust reverser inlet for Boeing 757 aircraft, and other Boeing aircraft components as described below, plus ancillary equipment, from Wichita/McConnell AFB, Kansas to Seattle/Boeing Field, Washington, utilizing Antonov's AN-124-100 aircraft. TAROM seeks authority to operate a total of seven weekly frequencies from any point or points behind Romania via any point or points in Romania and intermediate points in Belgium, Bulgaria, the Czech Republic, Denmark, France, Germany, Hungary, Ireland, Malta, the Netherlands and Slovakia to New York and Chicago, effective immediately through March 31, l999, with no more than five of the total seven weekly frequencies to be used for operations to New York.
Also requests authority for the period from April 1, 1999 through October 31, 2001, to operate scheduled international air transportation from behind Romania via any point or points in Romania and intermediate points to New York, Chicago and Los Angeles.
Further requests, in accordance with the same subparagraph of Annex IV of the Bilateral, that the Department specify in its exemption authority that TAROM may, at any time before March 31, 1999, operate a total number of weekly frequencies in scheduled international air transportation equal to the total combined number of weekly frequencies of any airline or airlines of the United States that may offer scheduled combination service to Romania with its own aircraft.
TAROM initially plans, as of March 28, 1998, to expand its operations to New York from two to four weekly frequencies and to expand its Chicago operations from once to twice weekly. It does anticipate, however, further expansions and is therefore making this request for all of the authority to which it is currently entitled under the Bilateral as an alternative to a series of individual applications for specific portions of this authority. Given the broad rights accorded under the Bilateral, each additional application that would be necessary would, as JAL has stated recently in a similar situation, "be largely a formality ... and ... would generate a small mountain of paper."

ORDER ISSUING FOREIGN AIR CARRIER PERMITS
The captioned applicants seek foreign air carrier permits under section 41301 of Title 49 of the U.S. Code in the indicated dockets. The applications are fully described in attachments to this order. Because the public interest bases for granting these applications are clear, the applicants' fitness is established by evidence of record and unchallenged, and there are no significant ownership and control questions, it is appropriate to use this simplified, Subpart Q procedure to grant the requested authority.

Application for Renewal and Amendment of Exemptions
By Orders 96-6-28, 96-9-28 and 98-1-17, the Department of Transportation granted or renewed the exemption authority of United Air Lines, Inc. ("United") to operate scheduled service between points in the United States, on the one hand, and Manchester, England (Docket OST-96-1348, Order 96-ó-28); Baku, Azerbaijan, and Ashkhabad, Turkmenistan (Docket OST-96-1560, Order 96-9-28); and Lyon, France, and Nairobi, Kenya (Docket OST-95-369, Order 98-1-17), on the other hand. These orders permit services to be operated in some cases via all points in Germany (Order 98-1-17) and in others via specific points in Germany, such as Frankfurt (Order 96-9-28) or Munich (Order 96-6-28). The exemption authority to serve Lyon and Nairobi is further conditioned in that United can offer service only "under its code-sharing arrangement with Lufthansa."
United also requests that its exemption authorizations be amended to allow United to serve these points from the U.S. via points in other countries which United is authorized to serve in addition to Germany and to offer service with code-share partners other than Lufthansa. This will permit code-share service, for example, via points in Scandinavia (Denmark, Norway and Sweden) on Scandinavia Airlines System ("SAS") or via points in the U.K. with British Midland Airways, Ltd. For example, British Midland is beginning service to Manchester from London Heathrow on March 29, 1998. The amended exemption authority is needed to allow United to code share on those services.

1998 U.S.-Japan Combination Service Proceeding

Since there is no certainty that services proposed for 1998 would actually be operated in 1998, it would be particularly unfair to award certificate authority based solely on the fact that an untested proposal contains a 1998 startup date. American's application for JFK-Tokyo and Boston-Tokyo authority to institute service in 1998 is conditioned explicitly on the availability of slots at Tokyo, but DFW itself has said, "Other than the three new U.S.-Narita services planned by the three MOU carriers" pursuant to pendente life authority, "any additional new U.S.-Narita services will probably be delayed until the second runway at Narita is built sometime after the year 2000."

Answer of The State of Hawaii to Motion and
Amended Motion of Hawaiian Airlines
With seven frequencies, Hawaiian would be able to offer a full pattern of daily service. If Hawaiian were only allowed to offer service three of four days a week, its services may be less appealing to busy Tokyo residents, who may be trying to work a quick getaway into a hectic schedule. Daily service is vastly preferable, and with 90 frequencies available, there is every reason for the Department to accommodate Hawaiian's modest request.
