These unforeseen circumstances have caused Air 4000 to substantially revise its initial operating plan. Air 4000 conducted a detailed market analysis, and as a result, has decided to focus initially on operating domestic charters in leisure markets and providing subservice for scheduled domestic airlines, which will provide the airline with a source of guaranteed revenue. Air 4000 plans to use MD-83 aircraft for these operations, which can accommodate up to 165 passengers. Air 4000's initial objective will be to establish itself as a leading charter airline in the U.S. To immediately establish itself in the market, Air 4000 plans to work in conjunction with prominent, well-established tour/travel organizations. Air 4000 has already explored arrangements with a number of tour operators, and has received assurances that the demand exists, particularly for operations with the MD-83 aircraft. This aircraft is known for its long-range capabilities (up to 2,800 miles fully loaded), strong passenger appeal, reliability and high efficiency. Air 4000 has received strong feedback from potential tour operators, with plans to target key areas within the United States and well-known leisure destinations in the Caribbean, Mexico and Latin America. If in the future, the Asian economy improves and demand for Asian-originating charters rebounds, Air 4000 will consider whether to revive its original operating plan.

Any significant expansion to extend the use of these coding systems to non-airline entity requirements would subject the airline industry to enormous costs. A 1992 study into converting CRSs to use three-letter airline designator codes, in place of the current twocharacter codes, estimated costs to the industry in the hundreds of millions of US dollars.
This led IATA to take strong measures to preserve the integrity of the present systems while at the same time trying to accommodate the needs of surface operators and CRSs. The measures proposed by IATA were approved by the DOT in 1995.
The best-case scenario for all would be the development of an integrated system where all modes of transport could be booked using the same functionality. However, widespread use of CRSs by non-airline companies would require that they adopt airline business practices. Moreover, a sharp increase in the number of subscribers using CRSs would also require the expansion of coding systems resulting in massive costs to airlines who are already satisfied with the performance of the CRSs.

By Order 96-9-16 the Department allocated Federal Express five weekly frequencies to expand its U.S.-Thailand all-cargo operations, in addition to one frequency previously allocated to Federal Express. That award was subject to the condition that it will expire automatically and the frequencies will revert to the Department for reallocation if they are not used for a period of 90 days. Under the terms of the order, Federal Express' frequency allocation would expire on April I, 1997, if Federal Express did not begin service by that date. On February 2S, 1997, Federal Express sought an exemption to extend its startup date to September 1. By Notice of Action Taken dated March 21, 1997, the Department granted the extension. (A Order 97-5-ó). Federal Express is currently operating five frequencies, and most recently operated its sixth frequency on November 15, 1997.

The clear intent of the Act is, therefore, that its coverage extend to any foreign air carrier that carries "passengers', which, as defined in the Act, would include flight crewmembers and other air carrier employees. Also considered to be passengers, of course, would be other persons who might normally be carried aboard an all-cargo aircraft. such as cargo handlers or grooms.

Mesa Air Group hereby withdraws its Notice of Suspension of Service at Gillette, WY, because it was inadvertently filed under the Department of Transportation's Essential Air Service regulations.
While Mesa is suspending service, Gillette, WY is neither an "eligible point" nor has an EAS determination has been made by the Department of Transportation for Gillette.
