No matter what services are added at other gateways, they will not provide competition for a combined American/TACA alliance where it is needed most -- at Miami. If American/TACA codesharing is to be allowed, the only way to assure any opportunity for competition at Miami is to adopt United's proposal to disallow code sharing by American/TACA on services to, from or via Miami. Given American's impregnable market position at Miami, that city's unique geographic position as a gateway to Central America and the fact that Miami-Central America local markets are the largest U.S.-Central America citypair markets by a considerable margin, there will be no competition for Miami-Central America traffic via other gateways, as the Department itself has found.

We currently have a joint-rate agreement with Delta Airlines, as well as others who serve the Salt Lake City hub. Additionally, we currently offer senior citizen discounts, pre-paid ticket discounts and frequent flier miles. The community has been most receptive to our efforts to fly to/from Reno, and hopefully with this new proposal, the community will receive this vital service link.

The White Pine County Commission is extremely pleased to learn of the proposal for Ely's Essential Air Service Subsidy submitted by Scenic Airlines. The proposal has several features we find very attractive for White Pine County. It would provide Ely with direct air service to both Reno and Las Vegas. This will answer a critical transportation need for our residents, local government, state and federal agencies, and ourbusiness community. The 19 passenger plane will provide more reliable, comfortable travel.Skywest and Scenic Air both have fine reputations and we have had a very strong workingrelationship with Skywest in the past.

Amend its foreign air carrier permit to authorize JAL to (i) engage in, in addition to operations permitted by its existing permit authority, both combination and all-cargo services between any point or points behind Japan, any point or points in Japan, any intermediate point or points, any point or points in the territory of the United States, and any point or points beyond the United States, without any limitation on frequency or capacity.
With respect to the immediate future, JAL plans to increase weekly combination frequencies as soon as possible in the Tokyo-Chicago and Los Angeles-Sao Paulo markets.

In the December 8, 1997 information submittal for Sky King, Inc., under the section titled FINANCIAL POSITION AND OPERATING PLANS encompassing pages 8 thru 11 of that submittal, Sky King, Inc. submits the following information for clarification. Specifically referencing item 1.(c) on pages 9 & 10 of the December 8, 1998 submittal, Sky King, Inc. mistakenly combined acquisition costs and pre-operating costs. For clarification Sky King, Inc. itemized pre-operating costs necessary to commence operations is $400,000, consisting of $170,000 in itemized expenditures and $230,000 in contingency reserve. Fully capitalized aircraft acquisition and improvement costs are anticipated to be $3,100,000, as delineated on page 10 of the December 8, 1997 submittal.

Tower Air, Inc. (New York-Kiev)

Tower Air has found that it is not feasible for it to inaugurate direct service to Kiev, Ukraine this year. It plans, however, to commence such service in May of 1999.
As a consequence, Tower Air will not object to giving TWA authority to serve Kiev indirectly via a code share arrangement over Paris - assuming, of course, that the French Government permits such service.
However, Tower air strongly believes that when it is in a position to start direct service to Kiev next Spring, its designation to do so will be available to it to do so. This can be accomplished either by the Department or TWA convincing Ukraine to allow TWA's code-share service to be operated outside the bilateral (as was the case with Delta and Varig's service to Brazil) or by giving TWA only temporary use of the last remaining bilateral designation.

United Air Lines, Inc. - (New Notice of Action Taken)

Scheduled foreign air transportation of persons, property, and mail between Chicago, Illinois, and Osaka, Japan. United stated that it planned to begin these services in early July 1998 and requested expeditious issuance of the exemption in order to start marketing these services February 16, 1998.
As noted in the Department's February 3, 1998, Notice regarding U.S.-Japan Combination Services, U.S.-Japan rights for incumbent carriers (United and Northwest) are unrestricted. The Notice went on to say that: "To the extent these carriers do not currently hold all of the authority that they need, they should file appropriate applications which we will process on an expedited basis." We found that United's application was plainly within the purview of the applications contemplated by our Notice, and we accordingly concluded that grant of the authority is consistent with the public interest. Regarding the position expressed by American, on February 13, 1998, we granted American's request in OST-98-3418.
